Put the job in writing before it starts.

Spell out the work, the price, when each payment is due and what happens if plans change. Then sign it together on a phone, or print it. It’s a template to start from, so have a local attorney look it over before you use it.

  • This is a starting template, not legal advice. Rules differ by state, including licensing, lien notices, cancellation rights for sales made at a customer’s home, and consumer protections. Have a local attorney review it before you use it.
  • Turn clauses on or off to fit the job. Optional ones start off, and the sections renumber themselves.
  • The payments have to add up to the full price. The tool tells you when they don’t.
  • Starting from an accepted estimate? The customer, scope and price carry over.
  • Everything runs in your browser. Nothing you type is sent to us, and signatures are never saved.

Job and dates

Where the work happens, if it’s different from the mailing address.

The work

What you’ll do, in plain words: materials, sizes, brands, rooms. Specific beats vague.

Anything a customer might assume is included but isn’t.

How is the job priced?

The total of the lines becomes the price.

Payment schedule

Set when each payment is due, as a percent of the price or a dollar amount. Together they need to add up to the full price.

Clauses

Turn on the ones that fit the job. Optional clauses start off. Sections 1 to 5 (work, exclusions, schedule, price and payments) are always in.

  • Section 6

Any change to the work, price or schedule is written up as a change order and signed before it starts.

Handy for small changes made on site. Turn it off if you want ink signatures only.

  • Section 7

What happens when you find a problem nobody could see before the work began.

Pick ones that fit your trade.

  • Left out

Lets you pass on a big jump in material costs, but only with the customer’s written OK.

  • Section 8

Who gets the permits, who pays the fees, and who meets the inspector.

    Who handles permits?
  • Section 9

Working hours, water and power, and keeping pets and children clear of the work.

  • Section 10

How the site is left and who hauls away the debris.

    How the site is left
  • Section 11

How long you stand behind your work and what the warranty doesn’t cover.

  • Section 12

What happens when a payment is late. The late fee and the right to pause work are both optional.

Some states cap late fees and interest. Only include a fee you’re allowed to charge.

Only after telling the customer in writing.

  • Section 13

Late decisions, a site that isn’t ready or no access move the schedule and can add cost.

  • Section 14

How each side can end the agreement and what gets paid if it does.

Signing at the customer’s home? Federal and state rules may require you to give the customer a separate written notice of their right to cancel within a few days. Check what applies to you before you use this agreement.

  • Section 15

The coverage you carry and your license number, from Your business above.

For example: general liability insurance and workers’ compensation for employees.

Add your license number under Your business to print it here.

  • Section 16

Talk it through first, then mediation, then court in the county where the work is done.

  • Section 17

This document plus signed changes is the full agreement. Earlier side promises don’t count.

This agreement is between ______________ (“we” or “us”) and ______________ (“you”) for the work described below at the job address above.

1. The work

We will do the following work: ______________________________________ ______________________________________

2. What is not included

Work not described in section 1 is not included unless we both agree to it in writing.

3. Schedule

We plan to start on ______________ and expect to finish by about ______________. These dates are estimates. Weather, material delays, inspections, changes to the work and other things outside our control can move them. If the schedule changes, we will tell you as soon as we can.

4. Price

The price for the work in section 1 is $__________. It changes only through a signed change order (see section 6).

5. Payments

PaymentWhen it is dueAmount
DepositWhen this agreement is signed10% of the price
Progress payment 1When the work is about halfway done50% of the price
Final paymentWhen the work is complete40% of the price
Each payment after the deposit is due within 7 days after we tell you its milestone has been reached.

6. Changes to the work

If either of us wants to change the work, the price or the schedule, we will write it up as a change order that says what is changing and how it affects the price and the schedule. Changed work starts only after we have both signed the change order. We both agree that approving a change order by email or text message is the same as signing it.

7. Hidden or unexpected conditions

Some conditions can’t be seen until the work begins, such as rot, water damage, old wiring, hidden pipes or buried debris. If we find one, we will stop that part of the work, show you what we found, and explain your options and any added cost. We will not do extra work because of it until you approve a change order.

8. Permits and inspections

We will get the permits this work needs and schedule the required inspections. Permit fees are included in the price.

9. Site access, utilities and pets

You will give us reasonable access to the job site during normal working hours. You will provide water and electricity for the work at no charge. Please keep pets secured and children clear of the work area while we are working, and tell us before we start about anything we should know, such as gate or alarm codes, areas to avoid, or belongings to move.

10. Cleanup and debris

We will tidy the work area at the end of each workday. When the work is done, we will clean up and haul away job debris.

11. Workmanship warranty

For 12 months after the work is complete, we will fix at no charge any problem caused by how we did the work. Tell us in writing (email or text is fine) as soon as you notice a problem. This warranty does not cover normal wear and tear, misuse, damage from accidents or weather, or work changed by someone else. Materials and equipment are covered by their makers’ warranties, which we will pass on to you. This warranty is in addition to any rights you have under the law.

12. Late payments

Payments are due as set out in section 5. If you can’t make a payment on time, please talk to us right away.

13. Delays on your side

If the work is held up by something on your side, such as late decisions or selections, the site not being ready, or no access, the schedule will be extended by the length of the delay. If a delay like this lasts more than 30 days, we may bill you for the work done so far and for reasonable costs the delay causes, such as extra trips or storage, which we will show you.

14. Cancelling this agreement

You may cancel this agreement at any time by telling us in writing. We may cancel it in writing if a payment is more than 14 days late, or if the job site is not safe to work on and the problem is not fixed within a reasonable time. If either of us cancels, you will pay for the work done up to that point, for materials ordered for this job that can’t be returned, and for any restocking fees on materials that can. We will refund anything you have paid beyond that. This section does not limit any right you have under the law to cancel within a set time, such as rights that can apply to agreements signed at your home.

15. Insurance and license

We carry general liability insurance. We will show you proof of insurance if you ask.

16. If we disagree

If we disagree about this agreement or the work, we will first try to settle it by talking it through. If that doesn’t work within 30 days, we will try mediation with a neutral mediator we both agree on, and split the mediator’s fee equally. If mediation doesn’t settle it, either of us may go to court in the county where the work is done. Either of us may use small claims court at any time for a dispute small enough to qualify.

17. The whole agreement

This document, along with any written changes we both sign, is our whole agreement about this work. It replaces anything said or written before. Any change to it must be in writing and signed by both of us. If any part of this agreement can’t be enforced, the rest still applies.

By signing below, we each agree to this agreement. Each of us should keep a signed copy.
